DEFINITIONS:
As used herein, “Customer” means the party identified on the face of an Order received by Boda Acrylic, LLC (“Boda” or “Seller”) or an Order Acknowledgement or Packing Slip (each may be referred to as a “Contract”) issued by Boda; and “Products” means all articles and materials furnished by Seller to Customer.
WARRANTY (LIMITED):
Seller makes no warranty of any kind, express or implied, except that the Products shall be free from defects in material and workmanship under normal conditions of usage and service for a period of one year after shipment date. Buyer assumes all risk and liability for results obtained from the use of the Products, whether used singly or in combination with other products. Seller makes no other Warranty, express or implied, and makes no warranty of merchantability or of fitness for any particular purpose and there are no warranties which extend beyond the description on the Contract. No employee or representative of Seller is authorized to change this warranty in any way or grant any other warranty.
TERMS:
F.O.B. Seller’s facility in Gibsonville, NC. Full payment for products purchased, including sales tax (if applicable) and outbound shipping charge, shall be received by Seller at time of order entry.
SHIPPING:
Products will be shipped via UPS, except for oversized items which will be shipped via common carrier (truck).
Customers can choose to have truck shipments sent by “Standard Shipping” as defined below or “White Glove Service” which includes delivery inside the home, unpacking or unboxing, setup of the item, and disposal of all packaging materials.
Requests for international shipments, shipments to Hawaii or Alaska, or expedited delivery will be quoted on a case by case basis.
Standard Shipping:
For large items shipped by truck under “Standard Shipping” arrangements, freight will be unloaded at the delivery site adjacent to the delivery vehicle and (if a residence) placed by the first floor doorway or inside a garage or covered area. Carrier will furnish one man per vehicle for unloading. Unloading does not include unpacking or assembling the items delivered by the carrier (see “White Glove Service” below). All large items shipped by truck will be delivered on a pallet and that pallet will be left with the customer unless “White Glove Service” is requested.
White Glove Service:
If “White Glove Service” is chosen by the customer, delivery service will include unpacking and uncrating of the product inside the home, setup of the product in the location identified by the customer, and disposal of all shipping and packaging materials.
Residential Delivery Confirmation:
Before attempting delivery to a private residence, carrier must reach agreement (oral or written) with the Customer regarding the date and time of delivery.
DAMAGES:
Returns are allowed only for damage incurred during transit. Customer is strongly advised to inspect all boxes at time of receipt and notate any evidence of damage on the Delivery Receipt. Doing so will strengthen Customer’s claim for damages incurred during transit. Concealed Damage claims must be submitted to the carrier within 5 days after receipt of shipment. Customer is responsible for filing damage claim with the carrier and Boda will assist them in such a situation. Customer must retain shipping carton(s) and all packaging materials. Boda will arrange for the carrier’s local office to send a representative to the delivery address to inspect the items and arrange for possible return to Boda. All return requests much be authorized by Boda prior to return of goods. Any returns received by Boda without RA# will be refused. All goods authorized for return must be shipped in original packing cartons with end caps and other reinforcing components securely in place, in original condition and freight prepaid. Returns must be received by Boda in original condition within 30 days of original ship date.
RETURNS:
Returns are allowed only for damage claims, whether incurred prior to shipment or in transit. All return requests for must be authorized by Seller’s customer service department prior to return shipment. Returns received without RA# will be refused. All goods authorized for return must be shipped in original packing cartons with end caps and other reinforcing components securely in place, in original condition and freight prepaid. Returns must be received by Seller within 30 days of original ship date.
GOVERNING LAWS:
This contract shall be governed by and interpreted under the laws of the State of North Carolina.
SALES TAX:
Shipments to customers located outside North Carolina will not be charged North Carolina sales tax. Shipments made to customers in North Carolina will be charged North Carolina sales tax unless they provide a completed NC Certificate of Resale.
